1. ACCEPTANCE

Old Book Centers and its subsidiaries and/or affiliates (hereinafter together “OLD BOOK CENTERS”) present a combination of online sources which include listed advertisements (collectively, the “Service”) on the website www.oldbookCenters.com and corresponding and the free application of the Platform (collectively, the “Platform”).

The Platform we are providing and the Service is provided to you subject to these OLD BOOK CENTERS Terms of Use (these “Terms”). For the purpose of the Terms and whosesoever the context so requires, the terms “you” and “your” shall indicate any person who uses or accesses, whether through standard or automatic means, the Platform we have or the Service in any way whatsoever, including persons browsing the Platform and its content, posting remarks or any content or replying to any announcements or content on the Platform. By using the Service, you consent to comply with these Terms. Additionally, when using a part of the Service, you agree to comply with any applicable posted guidelines for such Service, which may vary or be updated from time to time at Old Book Centers sole discretion. You read and agree that you are only liable for interpreting these Terms from time to time. Should you complain to any term or condition of these Terms, any guideline, or any following changes thereto or grow unhappy with Old Book Centers or the Service in any way, your only option is to directly discontinue use of Old Book Centers. These Terms may be updated by Old Book Centers at any time at its sole discretion. Old Book Centers may send you notices of changes to the Platform or the Sessions pursuant to Section xxi (I) herein. Old Book Centers may present a translation of the English version of the Terms into other languages. You read and agree that any translation of the Terms into other languages is for your benefit only and that the English version dictates the terms of your relationship with OLD BOOK CENTERS. Furthermore, if there are any discrepancies between the English version of the Terms and any translation, the English version of the Terms shall govern.

1. DESCRIPTION OF SERVICE AND CONTENT POLICY

We act as an online platform to allow our users who comply with these Terms to give, sell, and buy goods and services listed on the Platform we are providing. Although you may be capable of conducting payment and other businesses through the Platform, using a third-party website for transactions such as Old Book Centers is not in any way involved in such transactions. In conclusion, and as explained in more detail in these Terms, you herewith acknowledge and accept that Old Book Centers is not a party to such transactions, has no power over any part of such transactions, and shall have no responsibility to any party in connection with such dealings. You use the transactional Services and the Platforms at your own risk.

You agree that Old Book Centers does not control, and is not responsible for advertisements, directory information, trade listings/information, messages between users, including externally limitation e-mails sent from outside Old Book Centers domain or other means of computerized communication, whether in the Platform or another Third Party Website (defined below) or contributions, comments, user postings, records, images, photos, video, sounds, business listings/data and directory information or any other element made available through the Platform and the Service (“Content”), and that by using the Old Book Centers Platform and the Service, you may be exposed to Content that is objectionable, indecent, inaccurate, misleading, or otherwise offensive. You accept and agree that you are responsible for and must assess, and bear all risks connected with, the use of any Content, that you may not rely on related Content, and that under no circumstances will Old Book Centers be liable in any way for the Content or for whatever loss or damage of any kind acquired as a result of the browsing, practicing or reading any Content listed, e-mailed or otherwise made available via the Services. You accept and agree that Old Book Centers cannot and takes not pre-screen or endorse any Content, but that Old Book Centers has the right, in its sole and complete discretion, to refuse, delete or move any Content that is or may be prepared through the Service, for violating these Terms and such violation being produced to Old Book Centers knowledge or for any other purpose or no reason at all. Furthermore, the Old Book Centers and Content available through the Platform may contain links to other third party websites (“Third Party Websites”), which are entirely unrelated to Old Book Centers. If you link to online Third Party Websites, you may be directed to those online Third Party Websites’ terms and conditions and other policies. Old Book Centers makes no illustration or guarantee as to the correctness or authenticity of the knowledge contained in any such online Third Party Websites, and your linking to any different websites is entirely at your own risk, and Old Book Centers disclaims all liability thereto.
    • C. You accept and agree that you are solely liable to your Content submitted on, conveyed into, or linked from the Services and the importance of posting, sending, linking, or publishing it. More precisely, you are entirely responsible for all Content that you upload, e-mail, or otherwise make available via the Service. In association with such Content posted on, conveyed through, or connected from the Service by you, you declare, confirm, represent, warrant and agreement that: (i) you own or have and shall extend to, for such time the Content is accessible on the Platform, have the required licenses, rights, permissions, and consents to use such Content on the Service and Platform (holding without limitation all patent, trademark, business secret, copyright or other restrictive rights in and to any and all such Content) and authorize Old Book Centers to use such Content to enable inclusion and use of the Content in the manner contemplated by the Service, the Platform and these Terms; and (ii) you have the written consent, release, and/or permission of each and every identifiable individual person or business in the Content to use the name or likeness of each and every such identifiable particular person or company to enable inclusion and use of the Content in the manner contemplated by the Service, the Platform and these Terms. For clarity, you retain all of your ownership rights in your Content; however, by submitting any Content on the Platform, you hereby grant to Old Book Centers an irrevocable, non-cancellable, perpetual, worldwide, non-exclusive, royalty-free, sub-licensable, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Platform and OLD BOOK CENTERS’s (and its successors’) business, including without limitation for the purpose of promoting and redistributing part or all of the Platform and Content therein (and derivative works thereof) in any media formats and through any media channels now or hereafter known. These rights are required by OLD BOOK CENTERS in order to host and display your Content. Furthermore, by you posting Content to any public area of the Service, you agree to and do hereby grant to OLD BOOK CENTERS all rights necessary to prohibit or allow any subsequent aggregation, display, copying, duplication, reproduction, or exploitation of the Content on the Service or Platform by any party for any purpose. As a part of the Service, OLD BOOK CENTERS may offer the facility of automatically capturing the “Description” of your ad based on the images uploaded by you. OLD BOOK CENTERS makes no warranty the veracity or the accuracy of the generated Description. The Description may be edited by you at any time while your ad is live. You also hereby grant each user of the Platform (a) a non-exclusive license to access your Content through the Platform, and (b) the right to contact you with regard to the Content posted by you through private chat or any other means. The foregoing license to each user granted by you terminates once you or OLD BOOK CENTERS remove or delete such Content from the Platform. Further, you give OLD BOOK CENTERS the right to make available your Content to any third party in connection with the transaction contemplated in your classified advertisement.
    • D. OLD BOOK CENTERS does not endorse any Content or any opinion, statement, recommendation, or advice expressed therein, and OLD BOOK CENTERS expressly disclaims any and all liability in connection with User Content. OLD BOOK CENTERS does not permit copyright infringing activities and infringement of intellectual property rights on the Platform, and OLD BOOK CENTERS may, at its sole discretion, remove any infringing Content if properly notified in accordance with applicable law that such Content infringes on another’s intellectual property rights. OLD BOOK CENTERS reserves the right to remove any Content without prior notice. OLD BOOK CENTERS may also terminate a user’s access to the Platform if they are determined to be a repeat infringer or found to be indulging in any act contrary to these Terms. A repeat infringer is a user who has been notified of infringing activity more than twice and/or has had a user submission removed from the Platform more than twice. Further, at its sole discretion, OLD BOOK CENTERS reserves the right to decide whether any Content is appropriate and complies with these Terms.

  iii. CONDUCT

You agree not to post, e-mail, display, upload, change, publish, transfer, update or give any information on the Site, or unless making available Content:

    • ii. that is copyrighted or registered, preserved by trade secret or trademark, or otherwise subjected to third party exclusive rights, including privacy and publicity benefits unless you are the proprietor of such rights or have authorization or a license from their rightful owner to post the stuff and to grant OLD BOOK CENTERS all of the license rights given herein;
    • iii. that violates any of the preceding rational property rights of any individual, or is Content that you do not possess a right to do available under any law, regulation, contractual or fiduciary connection(s);
    • iv. that is dangerous, offensive, illegal, threatening, harassing, irreligious, defamatory, obscene, pornographic, pedophilic, abusive, invasive of different privacy or other rights, hateful, or racially, ethnically offensive, disparaging, reporting or encouraging money laundering or unlawful gambling or harms or could harm springs in any way or otherwise unlawful in any manner whatsoever;
    • v. that harasses degrades, threatens, or is hateful towards any person or group of people based on faith, gender, sexual orientation, race, ethnicity, age, or disability;
    • vi. that breaks any (local) equal work laws, including but not limited to those preventing the stating, in any advertisement for work, a choice or claim based on race, color, religion, sex, social origin, age, or disability of the applicant.
    • vii. that endangers the unity, integrity, security, safety or sovereignty of all Nations, friendly relationships with foreign states, or standard order or causes stimulus to the commission of any cognizable crime or prevents examination of any offense or is abusing any other nation;
    • viii. that includes individual or identifying data about another person without that person’s express consent;
    • ix. that mimics any person or entity, including, but not restricted to, an OLD BOOK CENTERS employee, or incorrectly states or otherwise misleads an affiliation with a person or object;
    • x. lies or misleads the addressee about the root of such messages or gives any information which is grossly offensive or threatening in nature;
    • xi. that is incorrect, false, misleading, deceitful, misinformative, or establishes “bait and switch” offer;
    • xii. that creates or contains “pyramid schemes,” “associate marketing,” “link referral code,” “junk mail,” “spam,” “series letters,” or free samples of a commercial nature;
    • xiii. that creates or contains any form of advertisement or solicitation if (1) posted in regions or categories of the Platform which are not charged for such purposes; or (2) e-mailed to OLD BOOK CENTERS users who have requested not to be communicated about other services, products or financial interests;
    • xiv. that includes connections to financial services or Third Party Websites, besides as allowed explicitly by OLD BOOK CENTERS;
    • xv. that promotes any illegal services or the sale of any items the sale of which is prevented or limited by applicable law, including without limitation items the sale of which is prohibited or governed by applicable law;
    • xvi. that includes software virus or any other computer code, data or programs intended to interrupt, damage, or limit the functionality of any machine software or device or telecommunications equipment or any other computer device;
    • xvii. that interrupts the normal flow of conversation with an excessive number of communications (flooding attack) to the service, or that except negatively affects other users’ experience to use the service; or
    • xviii. Employs misleading e-mail deliveries, or forged headers or otherwise managed identifiers to change the origin of Content conveyed through the service.

Additionally, you agree not to:

• • • xix. communicate anyone who has requested not to be contacted, or makes undesirable contact with anyone for any business purpose, specifically, share any user to post an advertisement on a third-party website or post any advertisement on account of such user; or to “stalk” or except harass anyone;
    • xx. make any slanderous or abusive comments or postings to or upon anyone;
    • xxi. receive personal data about other users or items for commercial or unlawful purposes;
    • xxii. use electronic means, including spiders, robots, crawlers, data drilling tools, or the like to download or scrape data of the service, except for internet search engines (e.g., Google) and non-commercial state archives (e.g., archive.org) that comply with our robots.txt file;
    • xxiii. post Content that is outside the regional area or not related to the local area, repeatedly post the same or comparable Content, or otherwise require unreasonable or disproportionately large loads on our servers and other infrastructure;
    • xxiv. post the identical item or service in many classified sections or forums, or in various metropolitan areas;
    • xxv. Attempt to gain illegal access to computer systems owned or managed by OLD BOOK CENTERS or involve in any activity that disturbs, reduces the quality of, interferes with the idea of, or impairs the service’s functionality or the Platform.
    • xxvi. use any form of electronic device or computer program (sometimes referred to as “flagging engines”) that enables the use of OLD BOOK CENTERS’s “flagging system” or other area control systems outdoors, each flag being manually started by a human that receives the flag (an “automatic flagging device”), or use any such flagging tool to separate posts of opponents, other third parties or to transfer posts without an objective good faith assurance that the post being flagged infringes these Terms or any relevant law or regulation.
    • xxvii. use any electronic device or software that allows the submission of electronic postings on OLD BOOK CENTERS without human interference or authorship (an “automatic posting device”), including without restriction, the use of any such electronic posting device in combination with bulk postings, or for electronic submission of postings at certain times or periods; or
    • xxviii. Any Content uploaded by you shall be directed to relevant laws and may be disabled or and may be subject to investigation under relevant laws. Moreover, if you are found to be in non-compliance with the laws and ordinances, these phrases, or the privacy policy of the Site, we may cancel your account/block your way to the Site, and we reserve the right to withdraw any non-compliant Content uploaded by you.

1. PAID SERVICES

We may require a fee to post content in or utilize some Service (“Paid Services“). OLD BOOK CENTERS has empowered OLD BOOK CENTERS Private Limited, (“OLD BOOK CENTERS” or “we” or “us“) to trade such Paid Services to its users. By posting Paid Services on the Website, you agree with OLD BOOK CENTERS, the terms of which are set out included. Requirements of the Terms relating to the content shall also apply to Paid Services. Further, you remain bound by the Terms combined with your use of the website and the Services. Currently, we offer the following kinds of features for Paid Services. Some of these stories may be made available to you by us, depending on your practice, category, geographic location, and buying medium. Pakistan’s laws shall govern the terms of Paid Services and the relationship between you and the OLD BOOK CENTERS. Any request you may have upon OLD BOOK CENTERS must be presented to the public regulation courts. We hold the right to modify the price at which these opinions are made available to you:

• Featured Ads

Featured Ads is an innovation that allows your advertisement’s performance in a designated area of the website and a highlighted manner (depending on the policies the content is being viewed) to recognize it from other content posted website. In the website’s designated area about Featured Ads, Features Ads are placed sequentially. Therefore, it is likely that a particular Featured Ad is not visible to you every time you browse through the website.

This feature has been implemented to enable users to draw attention to their advertisements and improve the likelihood of receiving possible buyers’ responses. We do not support an increase of a specified quantum in the acknowledgments received by you, and any representation on the website in this respect is merely indicative.

The term for which your Ad will be presented as a Featured Ad shall be the number of days specified at the time of buying the feature or 30 days from the initial date of posting the content on the website, whichever is first. There is no limit on the number of Featured Ads you may submit on the website. You can buy a single Featured ad or can avail bulk packages (“Featured ads packages”) based on your demand, and such packages may be given to you on a discounted price as stated on the website. OLD BOOK CENTERS reserves the right to limit the extent and manner Featured you may edit ads.

• Boost to Top

Boost to the top is a website features that hits your advertisement to the top of the ads listing space in the city-specific category in which the ad has been posted by the user. Your ad will continue in that spot until new ads are posted in that category, at which period it will move down respectively in the listing space.

This feature has been given to enable users to draw attention to their live ads and increase the possibility of receiving potential buyers’ responses. We do not warrant an increase of a detailed quantum in the responses obtained by you, and any description on the website in this respect is merely suggestive.

Boost to the top can be availed for a previously posted ad. But, it does not increase the legality of an ad currently 30 days from the posting time. 

• Auto Boost

Auto Boost is a website feature similar to our “Boost to Top” website feature (refer earlier) that bumps your ad to the top of the ad listing space in the city-targeted category in which the ad has been posted, only that Auto Boost makes this automatically at defined periods. OLD BOOK CENTERS shall have the sole discretion to restrict the frequency of such periods for hitting the ad that may diversify across categories, usage, and geographic location.

This website feature has been given to enable users to draw attention to their live ads and increase the probability of receiving responses from potential consumers, all continuingly with our operations’ support boosting your advertisement on top, while its validity, at a set periodicity. We do not warrant an increase of a named quantum in the responses received by you, and any representation on the website in this respect is simply indicative.

Auto Boost can be availed for an already posted ad. But, it does not raise the legality of an ad currently 30 days from the posting time.

• Paid Ads

The paid advertisement is a website feature, which allows you to post ads also after you have consumed your free limits in a category. The free limit determines the number of ads you can post for free in any category within a set periodicity. This limit may diversify across categories, usage, and geographic location. For example, if you have posted 3 ads in a category in the last 30 days and the available limit is 3 ads per month for such category, you will not be permitted to post a free ad after posting your third ad.

All ads posted by you within your account will be added to free limits. Any following change of phone number after posting an ad will not change the available limits.

You can either buy a single Paid ad or can avail bulk packages (“Paid ads package“) based on your terms, which shall be given to you on a discounted price as stated on the website.

The validity of Paid ads:

• Limited Paid advertisement package – In the Short Paid ads package, you can post a limited number of advertisements while the package’s validity. Paid advertisements in this package shall each be valid for 30 days from the time of posting notwithstanding of when it is posted by you through the life of the Limited Paid advertisements package.
• Unlimited Paid advertisements package – In the Unlimited Paid advertisements package, you can post unlimited advertisements during the validity of the package. Regardless of when you post an ad during the life of the package, the ad will only remain valid during the validity of the package.

Payment for Paid Services

Against selecting any website featured of Paid Services, you may be redirected to a third-party payment processing website such as Stripe, giving payment through different channels such as net banking, credit card, and debit card (“Payment Gateway”). You accept that Paid Services will be made accessible to you only upon receipt of the payment authorization from the Payment Gateway. Upon making payment to us, within any medium whatsoever, you guarantee that you can use the medium or otherwise pay us under the relevant law.

Refunds/Cancellation

If you want to delete or deactivate any Paid Services before the period for which it is active, we will not be subject to refund you for any unutilized credit. In case you are not able to avail the website Paid Services on the Old Book Centers on account of any technical ideas, on receipt of payment verification, similar units of the paid feature upon the ad units you were not capable of posting shall be credited to your account. For example, if you buy a package of 3 Featured Advertisements units out of which you have used only 2 units and were incapable of posting the left 1 ad unit as a Featured Advertisement on account of a technical glitch. In contrast, the lifetime of the package validity, you will be charged only 1 unit of Featured Advertisement to your account.

The above return policy shall not be fit in the case any content in your ad is found to be breaking the Terms, or there has been any abuse stated about your ad, or your ad is deleted or not re-posted on the Old Book Centers Website on account of any technical reasons due to any consequent editing done by you.

1. POSTING AGENTS

As used here, the term “Posting User/Agent” refers to a third-party User/agent, service, or mediator that offers to post Content/Ads to the service on behalf of others. OLD BOOK CENTERS prohibits the use of Posting Agents, directly or indirectly, without the express written permission of OLD BOOK CENTERS. Also, Posting Agents are not permitted to post Content on behalf of others, directly or indirectly, or otherwise access the service to post Content on behalf of others, except with express written permission or license from OLD BOOK CENTERS.

1. ACCESS TO THE SERVICE

OLD BOOK CENTERS awards you a restricted, revocable, non-select permit to access and utilize the Service for individual use.
